Massachusetts laws are very different from Federal laws and the majority of states, and MA laws would not give her a free pass if she were found to be affected by a temporary mental health issue. The problem is the mental health defense would normally result in confinement to a mental health facility, but if this was only an issue during/after pregnancy is she still a danger? Should she still serve time? Those are the questions the trial is trying to answer in real time.

Apparently you’re not aware of the laws in MA concerning this specific example. MA laws significantly differ from most states in that if there is a possibility of mental issues the burden is placed on the state to prove the person is competent. In short the exact thing you think the legal system is tilted towards is what is NOT happening to her because of the potential for mental issues.

Yeah that’s always been a hard pass for me. Insurance companies will always bend facts to suit them not having to pay out. It’s the same with police in deciding to arrest or charge you with something. They will bend facts to suit the outcome they want. Why give them extra information to use against you?

Well this isn’t wildly new information. Police can only document what they see or is said to them, and people aren’t going to admit they were on their phone while driving. Distracted driving is the single biggest factor associated with causing accidents, and phone use is number 1 in the subcategory.
